WCNC: Police: Nurse turned off alarm, gave more painkiller

The Charlotte Observer: Report reveals new details on nurse's actions

Nurse anesthetist Sally Jordan Hill administered a significant dose of pain medication without consulting a doctor and didn't participate in life-saving efforts when her patient -- a former Charlotte classmate -- showed signs of trouble, documents in the case contend.

Co-workers of Hill, now charged with murder in the 2001 death of Sandra Joyner, also say Hill was eating a biscuit and didn't immediately call for help when Joyner's condition started to deteriorate, according to a nine-page letter sent to Hill by the N.C. Board of Nursing.

Hill and Joyner were classmates 30 years earlier at Olympic High School. A source told the Observer a grudge had been festering for years, and co-workers told police they overheard Hill say Joyner stole her boyfriend.

Hill, 50, has been jailed for two weeks and has a bond hearing Monday.
The case -- a wealthy patient dying during a facelift with a high school classmate involved -- has drawn national attention. It has been discussed on MSNBC and police have taken calls from People magazine, "Good Morning America" and "Dateline."

Joyner died five days after she stopped breathing in the recovery room at Charlotte's Center for Cosmetic and Plastic Surgery after an April 10, 2001, facelift. Medical examiners ruled the death an accidental poisoning, likely caused by the painkiller. Police didn't get involved then.

The state's medical and nursing boards investigated. Both found Hill made serious mistakes, though neither accused her of intentional wrongdoing. Hill has not been a nurse since.

Joyner's family has not returned repeated calls from the Observer.

Members of a church Hill has attended for more than a decade and some nurses who used to work with her say Hill is a professional, Christian woman who was devastated by her patient's death. She would not have ignored warning signs or intentionally killed Joyner, they say.

"Only Sandra Joyner, me and Jesus were there and knew what happened," Hill told medical investigators. "I know that the patient was in trouble."

Joyner was late and apprehensive the morning of her facelift, Hill told medical investigators. Joyner was more talkative than usual, Hill thought, and told Hill that she was going through a "terrible divorce." She planned to start working again and thought the facelift would help.

Joyner did well during the surgery, where the doctor also worked on her lips, facial scars and lower eyelids. She was groggy but awake and talking when Hill wheeled her to the recovery room, Hill and others told investigators.

After Joyner was settled in a lounge chair, the recovery room nurse asked Hill to watch Joyner while she prepared for the next patient. Hill got a biscuit the doctor had brought in to celebrate Nurse's Day. She took it into the recovery room, and the two former classmates were alone for about 10 minutes.

Joyner complained that her eyes were burning. She apologized for being a "bad patient," Hill told investigators. Hill had given Joyner 5 cc's of fentanyl, a potent narcotic painkiller, in the operating room. In the recovery room, she gave her more, starting with 1 cc to "calm her down," she said. About five minutes later, she gave another 1 cc of the drug. She did not document the medications she gave Joyner in the recovery room, which she was supposed to do.

After the second dose, Hill said, is when the problems started.

A surgical technician noticed that Joyner's lips and fingernails were bluish. "I asked (Hill) if everything was OK, and she said, `fine,' " testimony in the letter says.

The recovery room nurse said she came in and placed Joyner on oxygen. The nurse said she asked Hill if she needed the doctor and Hill told her no, the letter said.

"I don't recall Sally doing anything but standing back," the technician told investigators. "She seemed very calm. I did not at first realize that it was an emergency situation."

Another surgical technician said at one point Hill was sitting at the counter eating. "One would not be alarmed that anything was wrong because she was eating."

Hill told investigators eating didn't distract her from monitoring Joyner. "After giving anesthesia for so long, I've developed a sixth sense," she said, adding she got one bite of her biscuit.

The technician said she remembered hearing Hill interact with Joyner. She repeatedly told her: "Take a deep breath," the tech said.

The recovery room nurse said Joyner's condition deteriorated, and she decided to get the doctor. Hill told investigators she was the one who asked co-workers to get the doctor.

When Dr. Peter Tucker, who performed the facelift, arrived, Joyner was in distress. Tucker started life-saving procedures; paramedics were called.

"The whole thing is like slow motion," Hill told medical investigators.

Joyner was rushed to Mercy Hospital and pronounced brain dead.

That afternoon, Hill told her office manager the problem "was all my fault," according to the letter. She later said she was upset when she said that.

Five days later, Joyner's organs were harvested for transplanting and life support was turned off.


The autopsy concluded that fentanyl likely caused Joyner's death.

Charlotte anesthesiologist Dr. Mark Romanoff, who is not associated with the Joyner case, said fentanyl is commonly used to control pain in the operating room, and 5 cc's would not be an unreasonable dose. He said 2 cc's in the recovery room is "a fairly significant dose" but not unreasonable if the patient is complaining of severe pain.

Romanoff said he rarely uses fentanyl in the recovery room because it causes patients to have apnea, or to stop breathing. "That's the thing you have to really watch out for. Morphine, Demerol and even Dilaudid ... work just as well, and the risk of apnea tends to be less at similar doses."

Occasionally, Romanoff said, he'll use fentanyl for recovering surgical patients because it works faster than the other medicines. "With proper monitoring, you can use it safely."

The nursing board accused Hill of failing to report information crucial to the safety of a patient and of failing to maintain accurate patient records. It also said Hill should not have been administering medicine in the recovery room without consulting Tucker. Hill said Tucker had OK'd her giving medication in the past -- and she believed she had his permission to do it without checking with him first.

Rather than fight the charges, Hill gave up her nursing license.

In a separate investigation, the state medical board disciplined Tucker for not supervising Hill properly. It concluded that Hill's actions were "grossly negligent."

Tucker has repeatedly declined comment through his office and lawyers.

The medical and nursing board cases and a wrongful-death lawsuit were all settled by fall 2004. Police and prosecutors said a tip led them to investigate Joyner's death this year.

Authorities haven't revealed what new information led to Hill's arrest.

"I've reviewed this a million times," Hill told medical investigators. "I can't think of anything I'd do different."

Christie's next week will sell a spaceship-load of Star Trek stuff in the first - and probably last - official auction of artifacts from the TV series turned pop-culture phenomenon.

CBS Paramount, which owns the Trek franchise, has decided to sell more than 1,000 of the tens of thousands of costumes, props, weapons and set dressings accumulated during the production of five live-action series and 10 theatrical films since 1966, when William Shatner's Captain Kirk first uttered his now-familiar "Space, the final frontier" on national television.

Trekkies, who are famous for their mania for collecting, are said to be over the moon at the chance to bid six-figure sums on Kirk's Starfleet uniform or that holy of holies, the Starship Enterprise-A model.

"Smaller collections have come on the market before, but this is the largest, the only one from studio archives and from all the films and series, and it's the 40th anniversary, so there's definitely a fervor about this," says Cathy Elkies, Christie's director of specialty auctions.

The entire hoard, grandly titled 40 Years of Star Trek: The Collection, will open for public viewing Saturday at Christie's Rockefeller Plaza in New York with the auction Oct. 5-7. Buyers also will be able to bid live online at Christies.com. Throngs of people are expected; some might be in costume.

Christie's is betting the sale will be huge, and the $3-million-plus estimated take probably is conservative.

Why? Because contrary to reputation, Trekkies are not just geeks with too much time on their hands. After all, Paul Allen collects Star Trek. In 2002, he bought Kirk's captain's chair from the original series for $250,000 for his Science Fiction Museum in Seattle.

"There is not a stereotypical Star Trek fan; they represent a wide spectrum of the population - attorneys, doctors, engineers, teachers and astronauts," says Denise Okuda, who with husband Michael worked on the series and films as scenic artists and wrote The Star Trek Encyclopedia.

The Okudas were hired as auction consultants and for the past six months have combed through five vast studio warehouses to pick out "the most valuable, iconic and coveted" items for the sale.

The Okudas expect that the items most prized by Trekkies will be the spaceship models, costumes (Elkies says some surviving cast members are interested in buying theirs) and behind-the-scenes items such as costumer's continuity notes.

Speaking Back to Islamists

While her security contingent waits outside the Georgetown restaurant, Ayaan Hirsi Ali orders what the menu calls "raw steak tartare.'' Amused by the redundancy, she speculates that it is intended to immunize the restaurant against lawyers, should a customer be discommoded by that entree. She has been in America only two weeks. She is a quick study.

And an exile and an immigrant. Born 36 years ago in Somalia, Hirsi Ali has lived in Ethiopia, Kenya, Saudi Arabia and the Netherlands, where she settled in 1992 after she deplaned in Frankfurt, supposedly en route to Canada for a marriage, arranged by her father, to a cousin. She makes her own arrangements.

She quickly became a Dutch citizen, a member of parliament, and an astringent critic, from personal experience, of the condition of women under Islam. She wrote the script, and filmmaker Theo van Gogh directed, "Submission,'' an 11-minute movie featuring pertinent passages from the Koran (such as when it is a husband's duty to beat his wife) projected on the bodies of naked women.

It was shown twice before Nov. 2, 2004, when van Gogh, bicycling through central Amsterdam in the morning, was shot by an Islamic extremist who then slit his throat with a machete. Next, the murderer (in whose room was found a disk containing videos of "enemies of Allah'' being murdered, including a man having his head slowly sawed off) used another knife to pin a long letter to van Gogh's chest. The letter was to Hirsi Ali, calling her a "soldier of evil'' who would "smash herself to pieces on Islam.''

The remainder of her life in Holland was lived under guard. Neighbors in her apartment building complained that they felt endangered with her there and got a court to order her evicted. She decided to come to America.

That was the smart move.

Holland evidently tolerates everything except skepticism about the sacramental nature of multiculturalism. One million of the country's 16 million residents are Islamic, and the political left has appropriated the European right's traditional celebration of identity grounded in racial and ethnic traditions and culture. But the recoil of many Dutch people from Hirsi Ali suggests that the tolerance about which Holland preens is a compound of intellectual sloth and moral timidity. She was more trouble than the Dutch evidently think free speech is worth.

Her story is told in a riveting new book, "Murder in Amsterdam,'' by Ian Buruma, who is not alone in finding her -- this "Enlightenment fundamentalist'' -- somewhat unnerving and off-putting. Having experienced life circumscribed by tribal and religious communities (as a girl she suffered the genital mutilation called female circumcision), she is a fierce partisan of individualism against collectivism.

She reminds Buruma of Margaret Thatcher's sometimes abrasive intelligence, and fascination with America. He is dismissive of the idea that she is a Voltaire against Islam: Voltaire, he says, offended the powerful Catholic Church, whereas she offends "only a minority that was already feeling vulnerable in the heart of Europe.''

She, however, replies that this is hardly a normal minority. It is connected to Islam's worldwide adherents. Living sullenly in European "dish cities'' -- enclaves connected by satellite television and the Internet to the tribal societies they have not really left behind -- many members of this minority are uninterested in assimilation into open societies.

She calls herself "a dissident of Islam'' because, given what Allah supposedly enjoins and what she knows is right, "the cognitive dissonance is, for me, too much.'' She says she is not "a militant atheist,'' but the emphasis is on the adjective.

Slender, elegant, stylish and articulate (in English, Dutch and Swahili), she has found an intellectual home here at the American Enterprise Institute, where she is writing a book that imagines Muhammad meeting, in the New York Public Library, three thinkers -- John Stuart Mill, Friedrich Hayek and Karl Popper, each a hero of the unending struggle between (to take the title of Popper's 1945 masterpiece) "The Open Society and Its Enemies.'' Islamic extremists -- the sort who were unhinged by some Danish cartoons -- will be enraged. She is unperturbed.

Neither is she pessimistic about the West. It has, she says, "the drive to innovate.'' But Europe, she thinks, is invertebrate. After two generations without war, Europeans "have no idea what an enemy is.'' And they think, she says, that leadership is an antiquated notion because they believe that caring governments can socialize everyone to behave well, thereby erasing personal accountability and responsibility. "I can't even tell it without laughing,'' she says, laughing softly. Clearly she is where she belongs, at last.

SOHH: Run DMC Caught Up In "Tricky" Legal Battle, Sued Over 27-Year-Old Song

Members of the rock band The Knack filed a lawsuit last week in Los Angeles against Run DMC claiming the group used an unlicensed sample for a song.

According to The Associated Press, the copyright-infringement suit claims Run DMC used major sections and a guitar riff from The Knack's 1979 hit "My Sharona" for their 1986 song "It's Tricky" without permission.

In addition to members of Run DMC, the suit is also levied at Rick Rubin, who produced "It's Tricky" as well as the group's management, publishers and record label. The lawsuit filed on behalf of The Knack members Doug Fieger and Berton Averre also claims they only recently discovered the their song was sampled. The Knack is seeking damages for all albums sold with "It's Tricky" in the track listing from 1986 onwards as well as attorney's fees.

Oh...the horses were scared because he pulled their tails...

KARE 11: Naked man scares women and horses

A naked man, a family home and horses, all were involved in a very strange story in a Texarkana, Arkansas.

Police received a call about a man who had entered a family's home illegally. According to the Smith family, the man walked into their home and headed to the bedroom saying he was sent here to have sex with the woman of the house, Linda Smith. "I said, I don't know who your are, but your not having sex with me and you need to get out of my house."

Linda and her daughter started pushing the man out and he started taking off his clothes. The women were scared. At the time, they had no idea what this now naked man would do.

When they grabbed a phone and called police, naked man fled and started chasing a horse in a nearby field.

That's where police found him, running nude through a pasture, chasing horses and pulling their tails.

The suspect is 19-year-old Tim Smith of Texarkana, no relation to Linda's family. He was charged with residential burglary, third-degree assault, fleeing, disorderly conduct and refusal to submit to arrest. No bond was set and he was being held for a mental evaluation.

I must have had dementia since I was 12...

Generally, I take the side of business against government intrusion in the marketplace, but this does seem a bit excessive...

News Interactive: $32,000 is 'too much for breast fondling'

A FEE of 25,500 euros ($32,000) is way too much for a woman to charge a man for fondling her bosom, a Finnish district court ruled.

I assume the judge conducted a thorough investigation. Whether he is an expert in the subject or not is another matter.

The court jailed a couple in their twenties for more than a year for charging a 74-year-old who suffers from dementia a total of 25,500 euros to enjoy the woman's breasts on 10 occasions.

That's $3200 a pop. Charlie Sheen can get two hookers to dress up as cheerleaders all night long for that kind of money.

"Based on general life experience alone, it is indisputably clear that a 25,500 euro charge is disproportionate to the compensation in question," Judge Hasse Hakki, who heard the case, said.

Nicely put, judge.

But he said the court in Kokkola, about 300 miles north of Helsinki, would not decide "the proper financial value of the compensation."

That is a fair concession to free market economics.

The retiree filed charges against the couple, who were convicted of extortionate overcharging, even though he told the court he paid the price willingly at the time.

Lansing State Journal: Kronk gym struggles to survive

DETROIT - Emanuel Steward sat down on the couch, hunched over and covered his face with his hands - the same hands that made him an amateur champion as a young man and later helped him tutor some of the greatest fighters who ever stepped in the ring.

"I haven't decided what I'm going to do yet," he said softly. "I don't know."

The Kronk - the dingy, overheated basement gym that has produced more than two dozen world champions - is nearly down for the count, and Steward isn't sure whether he should throw in the towel.

The 62-year-old Hall of Fame trainer has been reaching into his own pocket to keep the Kronk running in the eight months since Detroit shut down the recreation center that houses it because of a major budget shortfall.

The city is permitting the gym to stay open, provided that Steward continues to run it and submits a monthly fee to cover utilities.

But the potential knockout blow came last weekend, when police say thieves entered the building through a window and made off with copper pipes from the basement boiler room, cutting off the gym's water supply.

Steward has been told that it will cost $20,000 to $40,000 to fix the damage to the gym he has led for more than three decades. "I don't have that kind of money," he said.

So, he's down to two options: Figure out a way to get the money to keep the gym up and running again or open a new Kronk elsewhere.

Ideally, Steward would like to repair the damage at the Kronk, but he worries about not only the cost but also the likelihood of another robbery.

"What's going to stop them from breaking in again? That's my biggest concern," he said.

So, Steward is considering moving the Kronk to another location in Detroit, possibly to the site of a former Fitness USA location that closed five or six years ago.

In the meantime, Steward is renting space at a gym in Dearborn so his young fighters can train for upcoming matches.

The best of the Kronk's amateurs are scheduled to compete in the coming weeks in the National PAL Championships in Oxnard, Calif., and in late October, several Kronk professionals are to appear on a card at Joe Louis Arena in Detroit.

But the uncertainty about the Kronk's future and the prospect of scraping together enough money to send his young fighters across the country is wearing on Steward.

"This man is a legend. He doesn't deserve to have all this going down," said Bobby Bostick, a Florida fight promoter who is helping to put on the Joe Louis event.

Bostick also is trying to line up corporate sponsorship for the Kronk to help ease the financial burden on Steward, who says it costs him about $2,000 a week to run the gym.

Danny Flores, Requiescat in pace.

HUNTINGTON BEACH – Danny Flores, who played the saxophone and shouted the word “tequila!” in the 1950s hit song “Tequila!”, has died. He was 77.

Flores, who lived in Westminster, died Tuesday at Huntington Beach Hospital, said hospital spokeswoman Kathleen Curran. He died of complications from pneumonia, the Long Beach Press-Telegram reported.

The man sometimes called the “godfather of Latin rock” was born in Santa Paula but grew up in Long Beach. By age 5 he was playing guitar in church and at 14 he was a member of a trio that performed Mexican music.

In 1957, Flores was in a group that recorded some work with rockabilly singer Dave Burgess. One of the songs was based on a nameless riff Flores had written. He played the “dirty” saxophone part and repeatedly growled the single-word lyric: “tequila!”

The next year it appeared as the B-side of a single, credited to The Champs. Flores used the name Chuck Rio because he was under contract to a different record label.

“Tequila!” went to No. 1 on the Billboard chart and won a Grammy in 1959. Flores continued to play it for the next 40 years.

“I can honestly tell you he never got tired of playing that song,” said his wife, Sharee.

The song has been used in numerous commercials and TV shows. It became popular with a new generation after it was used in the 1985 movie “Pee Wee's Big Adventure.”

“After that, we got shows all over the U.S.,” said Mrs. Flores, who sang in the shows.

“All these younger people who hadn't heard it were suddenly in love with the song. Danny was just so proud of it.”

In addition to his wife, Flores is survived by seven children from previous marriages and 15 grandchildren. (Thanks to the San Diego Union-Tribune for this obituary.)

The government geniuses said they were going to forbid folks in Boiling Spring Lakes from building on their property to protect the trees favored by the red-cockaded woodpecker.

Understandably, many property owners immediately clear cut their land to protect its resale value.

If only the government and the neo-pagan thingee-worshippers would have minded their own business, the trees would still be standing.

If they really cared about those woodpeckers, they would have offered the landowners fair market value for the habitat before they tried to steal it.

The Herald-Sun: Fearing restrictions to save habitat, landowners clear cut woods

BOILING SPRING LAKES, N.C. -- What's black and white and dreaded all over?

In this booming coastal town, it's the tiny red-cockaded woodpecker.

During the past six months, ugly, stump-riddled gashes have appeared throughout the lush longleaf pine stands here as worried landowners clear cut thousands of trees to prevent them becoming homes for the endangered bird.

The chain saws started in February when the U.S. Fish and Wildlife Service put Boiling Spring Lakes, a state-designated bird sanctuary, on notice that rapid development threatened to squeeze out the woodpecker.

The agency issued a map marking 15 active woodpecker "clusters" and announced it was working on a new one that could potentially designate whole neighborhoods in the southeastern North Carolina town as protected habitat -- and subject to more stringent building restrictions.

Hoping to beat the mapmakers to the printer, landowners swarmed city hall to apply for lot-clearing permits.

Treeless land, after all, needn't be set aside for woodpeckers. Since February, the city has issued 368 logging permits, 90 in May alone, the vast majority without accompanying building permits.

The results can be seen all over town.

Along the roadsides, scattered brown bark is all that's left of once majestic pine stands. Mayor Joan Kinney has watched with dismay as waterfront lots across from her home on Big Lake have been gradually stripped down to sandy, denuded wastelands.

"Well, it's ruined the beauty of our city," says Kinney.

Since the town's founding in the early 1960s, the people of Boiling Spring Lakes and the bird with the little red cheek patches lived together in relative harmony. When he built his brick home 14 years ago, retired IBM engineer Bill Davis knew better than to cut down the two sap-streaked pines along the street out front if he didn't want to risk a fine.

"I don't have $100,000 I want to give away," the 71-year-old West Virginia native said with a laugh recently as he stood beneath the tin tag marking one of the trees as a protected nesting pine.

But the honeymoon ended when Fish and Wildlife warned town officials that issuing building permits in certain areas might make them liable for "inadvertent violations of the Endangered Species Act." Anyone convicted of killing, harming or "harassing" the bird could face up to a year in prison and $100,000 in fines.

The red-cockaded woodpecker -- or Picoides borealis -- was once abundant in the vast longleaf pine forests that stretched from New Jersey to Florida, but now numbers as few as 15,000.

The RCW is unique among North American woodpeckers because it nests exclusively in living trees. In one of those quirks of history, human activity has made this town of about 4,100 -- located in the nation's 29th fastest-growing county -- almost irresistible to the bird.

Long before there was a town, locals carved V-shaped notches in the pines, collecting the sap in buckets to make turpentine. These "cat face" wounds allowed fungus to infiltrate the tree's core, making it easier for the woodpecker to excavate its nest hole and probe for the beetles, spiders and wood-boring insects it prefers.

"And, voila! You have a perfect woodpecker habitat," says Dan Bell, project director for the Nature Conservancy in nearby Wilmington.

The woodpecker gouges a series of holes around the tree, creating "sap runs" to discourage the egg-gobbling black snake, the bird's chief enemy -- besides man. A milky-white coating resembling melted candle wax makes the cavity trees stand out among their unoccupied neighbors.

Because it can take up to six years to excavate a single nest hole, the birds fiercely defend their territory, says biologist Susan Miller in the Fish and Wildlife agency's Southern Pines office.

"They're passed from generation to generation, because it's such a major investment in time to create one cavity."

Like the woodpeckers, humans also are looking to defend their nest eggs.

Bonner Stiller has been holding onto two wooded, half-acre lakefront lots for 23 years to pay for his kids' college educations or cushion his retirement. He had both lots stripped of longleaf pines before the government could issue its new map.

"They have finally developed a value," says Stiller, a state legislator who gave away the trees in exchange for the clearing. "And then to have that taken away from you?"

People have overreacted, says Pete Benjamin, supervisor of the federal agency's Raleigh office.

Having a woodpecker tree on your property doesn't necessarily mean you can't build a house, says Benjamin. A landowner can even get permission to cut down a cavity tree, as long as an alternative habitat can be found.

"For the most part, we've found ways to work with most folks," he says.

But, Stiller asks, who wants to deal with the hassle of going through another layer of bureaucracy? And how many people have the tens of thousands of dollars it can cost to relocate a family of birds?

Some complain the town has been singled out for selective enforcement. But most of the region's longleaf forests have fallen to agriculture, urban sprawl or plantations of fast-growing commercial loblolly pines, which usually are harvested before they get mature enough to attract the woodpeckers.

"Boiling Spring Lakes, like it or not, has these old flattop longleaf, and no place else seems to," says Bell, whose group has purchased nearly 7,000 mainly wetland acres around the town since 1999.

To stop the rash of cutting, city commissioners proposed a one-year moratorium on lot-clearing permits. When they met Sept. 5, more than 60 people turned out -- double the normal contingent.

They were rewarded with their first glimpse of the latest federal bird survey.

The glossy map divided the town into red-outlined woodpecker foraging areas, each containing at least one purple-shaded blob indicating a nesting cluster -- 24 in all. Several entire neighborhoods were highlighted. The original map listed 437 lots that might be affected by a cluster; on the revised map, that number rose to 2,704 lots.

Now that the map is out, the city can't issue a building or tree-clearing permit for any affected property without first running it by Benjamin's office.

Both of Steve Lowery's vacant lots were shaded purple. As the meeting convened, a flatbed truck was hauling away the last of the pines Lowery ordered cut from one of the properties.

"I get one lot, and the woodpeckers get the other one," the construction company supervisor told the commissioners.

Lowery and others argued that since the new map dictated where cutting could occur, the city no longer needed the moratorium. But Commissioner Craig Caster, worried that landowners outside the current woodpecker zones would cut their trees to prevent the bird's spread, begged for even a two-month halt.

"I feel like the city is getting raped of its trees," he said. The measure failed.

The city does not own the trees, pinhead, and neither do you. Even the woodpeckers don't own them. The owners of the land upon which the trees sit own them.

Fish and Wildlife is currently investigating a complaint in town. But Benjamin says the agency is willing to work with Boiling Spring Lakes to develop a workable habitat conservation plan that could involve, among other measures, moving some birds to property owned by the Nature Conservancy.

"At the end of the day, there's nothing about this woodpecker issue that's going to prevent anybody from doing whatever they want with their property," he says.

Amen to that, Brother.

Lowery wasn't willing to take that chance. "I like wildlife," he says. "But I felt like 50 percent of something is better than 100 percent of nothing."

We owe a debt of gratitude to the men who built the F-14 and the men who flew it.

The Navy today is holstering the F-14 Tomcat, the top gun in its Cold War arsenal and one of the most recognizable warplanes in history...

“There’s something about the way an F-14 looks, something about the way it carries itself,” says Adm. Michael Mullen, chief of naval operations. “It screams toughness. Look down on a carrier flight deck and see one of them sitting there, and you just know, there’s a fighter plane. I really believe the Tomcat will be remembered in much the same way as other legendary aircraft, like the Corsair, the Mustang and the Spitfire.”

The Tomcat was designed in the late 1960s with one enemy in mind: the Soviet Union. Typically launched from an aircraft carrier, the Tomcat’s twin engines propelled it at twice the speed of sound. Its armaments deterred Soviet bombers designed to fire missiles at Navy ships.

“It was intended to do one thing really well,” says John Pike, a military analyst at GlobalSecurity.org, a think tank based in Alexandria, Va. “The Soviets evidently respected it. Their answer was to build bigger and faster bombers. Fortunately, those attacks never came.”

After the Soviet Union crumbled in 1991, the F-14 was something of a stray cat. It had no real enemy in a world with one superpower. Eventually, the Navy armed it with precision bombs and targeting systems and added attack missions to its resume. Tomcats, with their two-member crews of a pilot and a backseat radar officer, flew missions in Desert Storm, in the Balkans and, until February, in Iraq.

After today’s ceremony, the Navy will mothball some F-14s in the Arizona desert and ship others to aviation museums. A monument at Oceana Naval Air Station will be dedicated to the 69 Tomcat aviators who were killed while flying the plane, says retired rear admiral Fred Lewis, chairman of the Tomcat Sunset Committee, a non-profit group established to organize farewell ceremonies for the F-14. “That’s the risk we all accepted when we flew the plane,” Lewis says.

The only other country still flying F-14s after today will be Iran, Pike says. Starved for spare parts, the Iranians struggle to keep them in flight. Smuggled parts will be even harder to come by after the Navy retires the Tomcat.

“Nobody will be sorrier to see them go than the ayatollahs,” Pike says.

Mosnews: Remains of Danish-born Russian Czarina to Make Final Journey to St. Petersburg

The final journey back to Russia for the remains of Czarina Maria Feodorovna, the mother of the last czar, begins Saturday in a royal ceremony west of Copenhagen, The Associated Press reports.

Denmark’s Queen Margrethe and descendants of Russia’s deposed royal Romanov family were to attend the memorial service, which marks the beginning of Maria Feodorovna’s last voyage across the Baltic Sea to St. Petersburg. The casket of the Danish-born wife of Czar Alexander III will be buried with her family at the Peter and Paul Cathedral in the former Russian imperial capital, where a ceremony is planned for next week.

Danish and Russian government officials were also to attend Saturday’s ceremony at the cathedral in Roskilde, 40 kilometers (25 miles) west of Copenhagen, where Maria Feodorovna’s casket has been resting alongside Danish kings and queens since her death in 1928.

After the ceremony, a motorcade including the hearse will drive to Copenhagen, where a mounted army regiment will join the procession through the city and to the harbor. The coffin will be put aboard a Danish navy support ship, Esbern Snare, which is due to arrive in St. Petersburg on Sept. 26.

Since the end of the Cold War, the Romanov family have been working for the remains of Maria Feodorovna to be sent to Russia.

Born in 1847 as Princess Dagmar, the daughter of Denmark’s King Christian IX and Queen Louise, she converted from the Lutheran Church to the Russian Orthodox faith when she married Alexander. The couple had six children, including Nicholas II, who became czar in 1894 and was executed a year after the Bolshevik revolution.

Nicholas II and his family were killed in 1918, 16 months after he abdicated the throne. His remains were ceremoniously buried in 1998 in St. Petersburg. Maria Feodorovna fled St. Petersburg in 1917 and reached Copenhagen through the Crimean Peninsula and London.

If you chose D., Osama bin Laden, you are correct. As to why — come to think of it there are a lot of reasons he should not be listed with these great historical figures, but the reason I was thinking of is that these are people who died of typhoid fever. There is a rumor afoot that Osama should be added to this list — the French daily L'Est Republicain leaked a report from French intelligence that a low-level Saudi diplomat had mentioned at a mixer in Islamabad that bin Laden had succumbed to typhoid last August somewhere in Afghanistan.

The theory is attractive. Typhoid is not a common affliction these days, but has found safe haven in some locales. The disease is spread from person to person through infected feces, so it thrives in conditions of poor sanitation like, for example, caves and safe house basements. A 1997 study in Karachi Pakistan, where the disease is endemic, showed that there was a high risk of infection from eating tainted ice cream. Can you imagine? All that effort to conceal himself from his enemies and he is done in by dessert. “Mahmoud, bring me back an ice cream. Strawberry. I’ve been dying for some.”

But Osama would really have to try to die from typhoid fever. It is a highly treatable malady. Antibiotics take care of it most of the time, and even if untreated it is only fatal in 10-30 percent of cases. Anyway what happened to the kidney dialysis story? Osama has long been said to be under treatment for some kind of kidney ailment. We even knew the place in Pennsylvania where he got the filters, so it is said. The story surfaced again this summer. A report last July in the Asia Times had important information about Osama’s health from “Abdullah,” pseudonym of the son of “Sheikh Ibrahim,” nom de jihad of the number-two man in the Islamic Movement of Uzbekistan. In short, an impeccable source. Bin Laden “asked all of us to pray for his health,” Abdullah said. “For the past many months he has been on dialysis and just cannot move. My father never told me where he was when he met Osama ... but he was worried about his fast-waning health.” The timeline tracks with the reputed August expiration date, even if the cause does not.

But there has been no mention of anything of the sort in the jihadist chat rooms, and there surely would be some indication if bin Laden died. It would send a shock through that community, there would be no way to contain it. They might not know how, when or where he died, but the fact of it would be out there quickly. At the very least his putative successor(s) would be making their leadership bids. So any report that states that bin Laden died weeks or months ago is readily dismissible. Too bad.

Bill Clinton’s self-defense on terrorism falls flat.

From National Review Online, Byron York shows the world the latest tantrum from America's first Sociopath President was simply more of the usual Goober II nonsense in Bill Clinton’s Excuses. Unlike the Great Fornicator, Mr. York has actually read Richard Clarke's book.

(Nota bene: There is some salty language quoted in this article, kiddies. I left it in the post because when real men are frustrated by ignorant power-worshippers, they can lose their tempers and use intemperate language. In other words, consider the circumstances.)

“I worked hard to try and kill him,” former president Bill Clinton told Fox News Sunday. “I tried. I tried and failed.”

”Him” is Osama bin Laden. And in his interview with Fox News’ Chris Wallace, the former president based nearly his entire defense on one source: Against All Enemies: Inside America’s War on Terror, the book by former White House counterterrorism chief Richard Clarke. “All I’m asking is if anybody wants to say I didn’t do enough, you read Richard Clarke’s book,” Clinton said at one point in the interview. “All you have to do is read Richard Clarke’s book to look at what we did in a comprehensive systematic way to try to protect the country against terror,” he said at another. “All you have to do is read Richard Clarke’s findings and you know it’s not true,” he said at yet another point. In all, Clinton mentioned Clarke’s name 11 times during the Fox interview.

But Clarke’s book does not, in fact, support Clinton’s claim. Judging by Clarke’s sympathetic account — as well as by the sympathetic accounts of other former Clinton aides like Daniel Benjamin and Steven Simon — it’s not quite accurate to say that Clinton tried to kill bin Laden. Rather, he tried to convince — as opposed to, say, order — U.S. military and intelligence agencies to kill bin Laden. And when, on a number of occasions, those agencies refused to act, Clinton, the commander-in-chief, gave up.

Clinton did not give up in the sense of an executive who gives an order and then moves on to other things, thinking the order is being carried out when in fact it is being ignored. Instead, Clinton knew at the time that his top military and intelligence officials were dragging their feet on going after bin Laden and al Qaeda. He gave up rather than use his authority to force them into action.

Examples are all over Clarke’s book. On page 223, Clarke describes a meeting, in late 2000, of the National Security Council “principals” — among them, the heads of the CIA, the FBI, the Attorney General, the chairman of the Joint Chiefs of Staff, and the secretaries of State, Defense. It was just after al Qaeda’s attack on the USS Cole. But neither the FBI nor the CIA would say that al Qaeda was behind the bombing, and there was little support for a retaliatory strike. Clarke quotes Mike Sheehan, a State Department official, saying in frustration, “What’s it going to take, Dick? Who the shit do they think attacked the Cole, fuckin’ Martians? The Pentagon brass won’t let Delta go get bin Laden. Hell they won’t even let the Air Force carpet bomb the place. Does al Qaeda have to attack the Pentagon to get their attention?”

That came later. But in October 2000, what would it have taken? A decisive presidential order — which never came.

The story was the same with the CIA. On page 204, Clarke vents his frustration at the CIA’s slow-walking on the question of killing bin Laden. “I still to this day do not understand why it was impossible for the United States to find a competent group of Afghans, Americans, third-country nationals, or some combination who could locate bin Laden in Afghanistan and kill him,” Clarke writes. “I believe that those in CIA who claim the [presidential] authorizations were insufficient or unclear are throwing up that claim as an excuse to cover the fact that they were pathetically unable to accomplish the mission.”

Clarke hit the CIA again a few pages later, on page 210, on the issue of the CIA’s refusal to budget money for the fight against al Qaeda. “The formal, official CIA response was that there were [no funds],” Clarke writes. “Another way to say that was that everything they were doing was more important than fighting al Qaeda.”

The FBI proved equally frustrating. On page 217, Clarke describes a colleague, Roger Cressey, who was frustrated after meeting with an FBI representative on the subject of terrorism. “That fucker is going to get some Americans killed,” Clarke reports Cressey saying. “He just sits there like a bump on a log.” Clarke adds: “I knew he was talking about an FBI representative.”

So Clinton couldn’t get the job done. Why not? According to Clarke’s pro-Clinton view, the president was stymied by Republican opposition. “Weakened by continual political attack,” Clarke writes, “[Clinton] could not get the CIA, the Pentagon, and FBI to act sufficiently to deal with the threat.”

Now, that's funny.

Republicans boxed Clinton in, Clarke writes, beginning in the 1992 campaign, with criticism of Clinton’s avoidance of the draft as a young man, and extending all the way to the Lewinsky scandal and the president’s impeachment. The bottom line, Clarke argues, is that the commander-in-chief was not in command. From page 225:

Because of the intensity of the political opposition that Clinton engendered, he had been heavily criticized for bombing al Qaeda camps in Afghanistan, for engaging in ‘Wag the Dog’ tactics to divert attention from a scandal about his personal life. For similar reasons, he could not fire the recalcitrant FBI
Director who had failed to fix the Bureau or to uncover terrorists in the United States. He had given the CIA unprecedented authority to go after bin Laden personally and al Qaeda, but had not taken steps when they did little or nothing. Because Clinton was criticized as a Vietnam War opponent without a military record, he was limited in his ability to direct the military to engage in anti-terrorist commando operations they did not want to conduct. He had tried that in Somalia, and the military had made mistakes and blamed him. In the absence of a bigger provocation from al Qaeda to silence his critics, Clinton thought he could do no more.


In the end, Clarke writes, Clinton “put in place the plans and programs that allowed America to respond to the big attacks when they did come, sweeping away the political barriers to action.”

But the bottom line is that Bill Clinton, the commander-in-chief, could not find the will to order the military into action against al Qaeda, and Bill Clinton, the head of the executive branch, could not find the will to order the CIA and FBI to act. No matter what the former president says on Fox, or anywhere else, that is his legacy in the war on terror.

CBS 3: Family Gets Caught In Deadly Crossfire

Philadelphia Police are investigating a shooting that claimed the life of a five-year-old girl in the Strawberry Mansion section of the city.

The victim, Cashae Rivers, was riding in a car with her mother near 34th and Huntingdon Sunday, when bullets rang out in the 2500 block of Spangler Street.

According to police, another vehicle was firing shots when the car Rivers was traveling in was struck.

Two bullets entered the rear of the vehicle where Rivers and her one year-old brother were sitting.

Shortly after realizing her daughter was shot, River's mother stopped at a fire station at 26th and York Streets where medics arrived and transported the girl to Temple Children's Hospital.

"All we know is she's not here. Cashae is not here, and that’s wrong," said Cashae's cousin, Toya West.

The family of Cashae Rivers wants whoever is responsible for taking Cashae's life captured.

Anita Robert-Jones was in the area when the baby was shot and ran towards the scene when she hear Cashae's mother screaming.

"The baby was in her arms, like lifeless. The baby was just lying in her arms, "said Robert-Jones.

Cashae is the 287th murder victim in the city this year.

Anyone with information on this shooting is asked to call police. No arrests have been made and details regarding a reward will be announced Monday.

AP: Clinton, Fox anchor battle in interview

In a combative interview on "Fox News Sunday," former President Clinton defended his handling of the threat posed by Osama bin Laden, saying he tried to have bin Laden killed and was attacked for his efforts by the same people who now criticize him for not doing enough.

"That's the difference in me and some, including all of the right-wingers who are attacking me now," Clinton said in the interview. "They ridiculed me for trying. They had eight months to try, they did not try."

Heehee! How about eight years, you impotent pansy?

Clinton accused host Chris Wallace of a "conservative hit job" and asked: "I want to know how many people in the Bush administration you asked, 'Why didn't you do anything about the Cole?' I want to know how many people you asked, 'Why did you fire Dick Clarke?'"

Ack! It's The Return of the Vast You-Know-What!

He was referring to the USS Cole, attacked by terrorists in Yemen in 2000, and former White House anti-terrorism chief Richard A. Clarke.

Wallace said Sunday he was surprised by Clinton's "conspiratorial view" of "a very non-confrontational question, 'Did you do enough to connect the dots and go after Al Qaida?'"

"All I did was ask him a question, and I think it was a legitimate news question. I was surprised that he would conjure up that this was a hit job," Wallace said in a telephone interview.

Never interview a man who has spent his entire life trying to stifle his conscience.

Clinton said he "worked hard" to try to kill bin Laden.

Yeah, he worked that fat chick with low self-esteem onto her knees. That really shook Osama Bin Goat Rape to his core.

"We contracted with people to kill him. I got closer to killing him than anybody's gotten since," he said.

Yeah, Bill, you were a regular Marshall Dillon. Shut up and go back to trying to silence your conscience with low self-esteem-afflicted fat chicks. Cheap, dirty, meamingless sex has never actually shut up a conscience, but at least we won't have to listen to you spew your deranged nonsense.

He told Wallace, "And you got that little smirk on your face and you think you're so clever, but I had responsibility for trying to protect this country. I tried and I failed to get bin Laden. I regret it, but I did try and I did everything I thought I responsibly could."

The interview was taped Friday during Clinton's three-day Global Initiative conference.

On NBC's "Meet the Press," also taped Friday and aired Sunday, Clinton told interviewer Tim Russert that the biggest problem confronting the world today is "the illusion that our differences matter more than our common humanity."

That is exactly the kind of line that works on fat chicks with low self-esteem.

"Oooooh, Mr. President! It's so...so...chafed."

Pioneer Press: A friendship gone terribly wrong

EAST ST. LOUIS, Ill. — By all accounts, Tiffany Hall and Jimella Tunstall were like sisters, survivors in a place defined by crime, poverty, crumbling buildings and potholed roads. With numbing grief, the families of the two quiet loners are trying to fathom how things went so horrifically wrong.

Hall, 24, is jailed on $5 million bond, accused on Saturday of killing Tunstall, 23, and the fetus that authorities say was cut from her womb, perhaps with scissors.

Later Saturday, a furious two-day search for Tunstall's missing children ended with another grisly discovery: the children's decomposing bodies stuffed in the washer and dryer at their apartment.

Preliminary autopsies Sunday show they were drowned, said Ace Hart, a deputy St. Clair County coroner. There were no signs of physical abuse or trauma on the children and toxicology tests were pending "to see if they were poisoned or possibly drugged," he said.

While in custody, Hart said, Hall told investigators she killed the children at another location, then hauled them home and hid them in the washer and dryer.

Refusing to discuss a motive, prosecutors say Hall killed Tunstall, who was seven months pregnant, on or about Sept. 15. Later that night, Hart says, Hall was taken to a hospital after she summoned authorities to Frank Holten State Park, where police found her with a dead baby she claims she delivered stillborn.

The baby girl showed no signs of trauma and an autopsy the next day failed to pinpoint a cause of death.

"We didn't even figure it was a homicide," Hart said.

During a funeral service for the baby, Hall confided in her boyfriend that the child belonged to a pregnant woman she killed, and the boyfriend then told police, Police Chief James Mister said.

By that time, authorities already had found Tunstall's body and a scissors near the sprawling state park where Hall had summoned police six days earlier.

By the next morning, investigators were imploring the media and public to help find Tunstall's three children, who they said were last seen four days earlier with Hall. A frantic search by dozens of law enforcers, volunteers and cadaver dogs proved fruitless. Though investigators had been inside Tunstall's apartment on Friday to get photographs of the missing children, they found nothing unusual there, Hart said. They returned Saturday night when Hall, who has two children of her own, "fessed up where the kids were," Hart said.

Police found 7-year-old DeMond Tunstall's body in the dryer and Ivan Tunstall-Collins, 2, and Jinela Tunstall, 1, in the washer.

"Any time you have three deceased children, it's a very emotional time," Illinois State Police Capt. Craig Koehler said. "All these investigators have worked tirelessly with one outcome in mind — to find these children alive."
