ONE of the most important right-to-life appeals to ever come before a British court began yesterday as doctors called for clear guidelines on when it is appropriate to withdraw treatment from a terminally ill patient.
Last year, Leslie Burke, 45, who suffers from the degenerative brain condition cerebellar ataxia, won the right to stop doctors withdrawing treatment when his illness reaches its final stages.

But in an historic case at the Court of Appeal in London, the General Medical Council (GMC) is arguing the decision puts doctors in "an impossibly difficult position".

In the wake of the controversial case of Terri Schiavo in the US, lawyers for the GMC want to clarify how much treatment should be given to terminally ill patients.

Hearing Mr Burke’s case at the High Court in London in May last year Mr Justice Munby said that if a patient is competent - or, if incompetent, has made an advance request for treatment - doctors have a duty to provide artificial nutrition or hydration (ANH).

Yesterday, Philip Havers, QC, representing the GMC, told three appeal judges headed by the Master of the Rolls, Lord Phillips: "In other words, the doctor must provide the treatment which the patient demands notwithstanding that the doctor’s clear professional view is that the treatment will provide the patient with no clinical benefit or will be futile."
He said this was not the law - a patient did not have a right to require the provision of any particular form of treatment.

Mr Burke, of Mardale Road, Lancaster, sat in court in his wheelchair as Mr Havers outlined the GMC case for overturning the ruling by Mr Justice Munby.

The scary thing is that thousands of these cases are "resolved" every day and nobody but the victims, the killers, and the family members inconvenienced by the ill and infirm notice.
